The Navi Mumbai Municipal Corporation (NMMC) is committed to taking a proactive stance against all sources of pollution. Recently, NMMC issued an additional 79 notices to builders and developers for violations of the Construction Dust Control Rules. This action was taken to address the severe air quality problem that the City has been experiencing, which has reached “Very Poor” levels on the national air quality scale.
The enforcement action started on November 28-29, 2025. NMMC officials inspected construction sites across the city. They found serious violations. Now, strict penalties and possible work stoppages await non-compliant developers.

Why Is Air Quality So Bad Right Now?
The situation is serious. Current air quality readings show:
- AQI: 189 (Unhealthy range)
- PM2.5: 108 µg/m³ (harmful levels)
- Nighttime peaks: AQI 375 (Very Poor)
Rabale and Ghansoli areas recorded the worst numbers. One Rabale monitor hit AQI 280—dangerous for everyone, especially children and elderly people.
What’s causing this? Three main sources:
1. Construction Activity – Dust from building sites is a huge problem. Without proper construction dust control measures, uncovered materials, open vehicle transport, and broken dust-suppression equipment all contribute heavily to pollution.
2. The emissions from local industries – Particularly those located in Rabale, Mahape, and the MIDC Belt all produce large quantities of harmful gases, and during the winter months these gases remain near the surface of the earth due to inversion layers.
3. Vehicle Traffic – Millions of cars, trucks, and buses pass through daily. Road dust and exhaust combine to create thick smog.

What Exactly Are Construction Dust Control Violations?
NMMC inspectors found serious safety lapses in construction dust control practices:
- Broken fogging and sprinkler systems
- Poor or missing barricading around sites
- No wheel-wash facilities for construction vehicles
- Uncovered material stacks exposed to wind
- Open debris transport in vehicles (not covered)
These violations break the NMMC’s August 2024 rules (called Standard Operating Procedure or SOP). These rules mandate strict construction dust control at every building site in the city.
Understanding the 8-Day Compliance Deadline
Builders have 8 days to fix violations and implement proper construction dust control. They must:
- Install working dust-suppression systems (fogging, sprinklers)
- Set up proper barricading (6-meter metal sheets minimum)
- Build wheel-wash facilities for all vehicles
- Cover all construction materials with tarpaulin
- Use only covered vehicles for debris transport
If they don’t comply? Construction can be halted for up to 1 week. This creates serious financial pressure on builders.
NMMC Commissioner Kailas Shinde made the stakes clear: “Citizens are already suffering from smog. Developers and businesses must act responsibly. Pollution control is not optional, it is mandatory.”
How NMMC Monitors Construction Dust Control
The municipal corporation isn’t just issuing notices. They’re actively monitoring sites daily.
Daily inspection teams include:
- Engineers
- Health inspectors
- Sanitation workers
The various NMMC Teams monitor construction activities, concrete manufacturing plants, quarry operations, and commercial kitchens; as well as operate surprise inspections at construction projects located in the major township areas of Nerul, Kharghar, Airoli, and Ghansoli as well. In each instance, the Senior Management of NMMC is directly involved in the evaluation of all major Township Projects to ensure the proper implementation of the Construction Dust Control Rules.

Parallel Dust Suppression Operations Across the City
Beyond enforcing construction dust control at sites, NMMC runs citywide dust-suppression programs:
- Special vehicles spray fine mist along Thane-Belapur Road
- Rabale-Mahape industrial belt gets regular misting
- Mechanical sweepers clean pavements and service lanes
- High-pressure jet-spray machines clear accumulated silt
These operations run more frequently in winter when loose soil causes more pollution without proper control.
Why Winter Makes Dust Control Even More Critical
Winter weather makes pollution worse. Wind speeds drop. Air doesn’t move properly. La Niña conditions (starting September 2025) make this worse by slowing ocean breezes that normally help clear Mumbai’s air.
During winter, proper construction dust control becomes absolutely essential because:
- 3-5 AM: Peak pollution hours (thermal inversion traps pollutants near ground)
- Daytime: Slight improvement (warming and wind help disperse particles)
- Night: Pollution levels return to dangerous levels
Without strict construction dust control, these problems multiply during the winter season.
Health Warnings: Who Should Be Careful?
Current pollution levels are 21 times higher than WHO safety standards. Health risks include:
- Persistent coughing
- Breathing difficulties
- Eye and throat irritation
- Asthma attacks
- Increased heart attack and stroke risk
Most at-risk groups:
- Children
- Elderly people
- People with asthma or heart conditions
- People with weak immune systems

Why Court Orders Back This Construction Dust Control Drive
This enforcement isn’t just NMMC action. Bombay High Court issued strict orders in December 2023. The court mandated 27 detailed rules for construction dust control at all building sites.
The court appointed a 5-member inspection team on November 27, 2025. There’s a scheduled hearing on December 15, 2025 to review construction dust control compliance.
The court’s message is clear: construction companies cannot ignore pollution control.
Learning From Previous Enforcement Actions
This isn’t the first time. In February 2025, NMMC issued notices to 87 developers for construction dust control violations and collected ₹1.40 crore in fines (about $167,000).
The fact that new violations appeared by November shows that construction dust control enforcement must be continuous and that some builders don’t take these rules seriously.
What Residents Can Do for Personal Protection
While authorities enforce construction dust control at building sites, residents should protect themselves:
- Use N95 masks outdoors
- Check AQI apps daily
- Keep windows closed during bad air days
- Use air purifiers indoors
- Avoid outdoor exercise early morning or evening
- Stay hydrated
The Bigger Picture: Navi Mumbai’s Rapid Growth
Navi Mumbai is growing fast. Population is approximately 1.636 million people. The new airport opening December 25, 2025 will add even more construction activity.
This growth is good for the city’s future. But it requires responsible construction dust control and pollution management. Builders, industries, and government must work together.
Looking Ahead: Will Compliance Happen?
Winter pollution will likely continue through December-January. NMMC will keep inspecting. Courts will continue monitoring.
The key question: Will builders actually implement proper construction dust control? Or will we see more notices and penalties?
Navi Mumbai’s residents deserve clean air. The enforcement action shows authorities are serious. Now it’s time for the construction industry to prove it’s serious about construction dust control too.
